The case has been described as the first \u2018insider trading\u2019 prosecution brought within the NFT world.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Here\u2019s what we know:&nbsp;<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In June 2022, the Department of Justice charged Chastain with wire fraud and money laundering.&nbsp; A Twitter user first flagged the transactions in late 2021, and Chastain\u2019s scheme was subsequently confirmed by OpenSea, which pledged to tighten its controls.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Chastain allegedly made over $50,000 by \u201cusing his knowledge of confidential information to purchase dozens of NFTs in advance of them being featured on OpenSea\u2019s homepage,\u201d according to the FBI\u2019s Michael Driscoll in a statement last year.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In closing arguments, Reuters <a href=\"https:\/\/www.reuters.com\/legal\/ex-opensea-manager-convicted-nft-insider-trading-case-2023-05-03\/\"><u>reported<\/u><\/a>&nbsp;that prosecutor Thomas Burnett said that Chastain \u201cabused\u201d his status at OpenSea, violating its confidentiality agreement.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Chastain\u2019s lawyer, Daniel Filor, argued that he did not break any company rules with the trades.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">OpenSea asked Chastain to resign in September 2021, when the NFT powerhouse additionally said it was putting in place new practices to prevent similar future internal lapses.&nbsp;&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">An OpenSea spokesperson previously told Blockworks that Chastain resigned because he was found to be \u201cin violation of our employment policies and direct conflict with our core values and principles.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Before the start of the trial, OpenSea CEO told prosecutors that the case against Chastain was \u201cunfair\u201d and that it impacted his mental health, according to court documents.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Chastain had filed five motions to drop evidence regarding his OpenSea compensation and exclude terms such as insider trading\u2013arguing that NFTs are not securities.
